Terms of Use for Widgetform

Welcome to Widgetform, a service developed by Sergei Suslov (Sole Professional No. 105731), based in the United Arab Emirates ("We," "Us," "Our," or "Company"). By installing or using the Widgetform application ("App" or "Service"), you ("User" or "You") agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not install or use the App.

1. Description of Service

Widgetform allows users to integrate a configurable widget into their websites to collect user inputs and store them. Users can configure forms and websites independently, enabling the reuse of forms across multiple websites.

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet the eligibility requirements. If you are under 16, you are prohibited from using the Service.

3. Installation and Use

The App can be integrated into your website by embedding a script. You are responsible for ensuring the script is correctly installed, and that it complies with any technical requirements for your website.

3.1 JavaScript Requirement

The widget provided by our service requires JavaScript to be enabled in the user's browser to function correctly. By using the widget, you acknowledge and agree that enabling JavaScript is necessary for its proper operation. We are not responsible for any issues, errors, or limited functionality resulting from the user disabling or restricting JavaScript in their browser settings.

4. Subscription Plans

Widgetform offers a single pricing plan called the “Standard” plan. Users can subscribe on either a monthly or annual basis. Subscriptions remain active for the duration of the current paid period, even if canceled, granting continued access until the end of that period.

4.1. Refund Policy

You may request a refund within the first 14 days after purchasing a subscription. To initiate a refund, you must contact us at contact@usewidgetform.com with your request. Refund requests made after the 14-day period will not be accepted. Upon approval of your refund, your subscription will be canceled, and access to the Service will be revoked. Please allow up to 10 business days for the refund to be processed.

If a refund or chargeback is initiated, the subscription will be immediately deactivated, and access to the Service will be revoked. The Company reserves the right to permanently block any user who initiates a refund or chargeback from using the platform. Abuse of the refund process, including frequent or fraudulent chargebacks, may result in legal action.

4.2. Plan Change Policy

You may change your subscription plan only at the end of your current subscription period. To change your plan, you must first cancel your current subscription and allow the current subscription period to expire. Once your subscription period has ended, you may subscribe again with the desired plan. Please note that any changes to your plan will not take effect until the current subscription period has ended, and no refunds or partial credits will be issued for unused time on your current subscription.

5. User Responsibilities

By using the Service, you agree to:

Provide accurate and up-to-date information when installing and using the App.
Ensure that your use of the Service complies with all applicable laws and regulations.
Not use the Service for any illegal, fraudulent, or unauthorized purposes.
Refrain from actions that could overload, disrupt, or interfere with the proper functioning of the Service, including but not limited to the use of bots, scripts, or automated tools to access or manipulate the App.
Not reverse engineer, decompile, or attempt to extract the source code of the Service.

Violations of these responsibilities may result in the suspension or termination of your access to the Service, without notice.

6. Data Collection and Privacy

We collect and use your data in accordance with our Privacy Policy. By using the Service, you consent to the collection, processing, and use of your information as outlined in the Privacy Policy. You agree to ensure that any data you collect from third-party users via the Widgetform complies with applicable privacy laws, including obtaining necessary consents where required.

7. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service. Users abusing the Service through excessive API requests, unauthorized use, or tampering with features may be restricted or banned.

8. Termination

We reserve the right to terminate or suspend your access to the Service at any time, for any reason, including but not limited to non-compliance with these Terms, with or without notice. Upon termination, your right to use the Service will immediately cease. The Company also reserves the right to take legal action for any misuse of the platform that results in harm to the Service or other users.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available," without any warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components. You assume all risks associated with your use of the Service.

10. Limitation of Liability

To the fullest extent permitted by law, the Company and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising from:

Your access to or inability to access the Service.
Any unauthorized access to or alteration of your data.
Any bugs, viruses, or malicious software transmitted through the Service.
Errors, inaccuracies, or omissions in any content available through the Service.

11. Disputes Resolution

If you have any concerns or disputes about the Service, you agree to first attempt to resolve the issue informally by contacting us. If a resolution cannot be reached, both parties agree to submit to the exclusive jurisdiction of the courts of the United Arab Emirates.

12. Governing Law

These Terms will be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions.

13. Changes to the Terms

We reserve the right to update these Terms from time to time. Any changes will be posted on this page, and it is your responsibility to review the Terms regularly. Changes become effective upon posting.
